If this changes with 2.10, we can certainly consider it though.
It appears the note about IEEE 802.11ax HE support being experimental/WIP has since been removed (refer hostapd/defconfig file in project source). Also one mention of 802.11ax in the ChangeLog for v2.10 - 'extended HE (IEEE 802.11ax) support, including 6 GHz support'.
