I can't reproduce. From a quick google search, it seems that is error is caused because the flac file has ID3 tags instead of flac tags. What's the output if you run 'flac --ogg' on the file?

$ flac --ogg foo.flac

ERROR: input file foo.flac has an ID3v2 tag

You'll need to fix the files then. See:
http://blog.tordeu.com/?p=61
for more info. I haven't tried any of this so you may want to keep a copy of the original files to make sure the conversion is OK. There might be other way to do so.
